Terms and Conditions

GENERAL TERMS AND CONDITIONS (EU/International – 2026)

 

 

I. Introductory Provisions

 

  1. These General Terms and Conditions (hereinafter "GTC") are issued by: Vačice Sleepwear, spol. s r.o., ID (IČO): 53046765, Tax ID (DIČ): 2121232487, with its registered office at Krížna 144/24, 931 01, Šamorín, Slovakia. Registered in the Commercial Register of the District Court Trnava, Section: Sro, Insertion No.: 46584/T. Contacts: ahoj@vacice.sk, www.vacice.com, +421 903 482 103 (hereinafter "Seller").

  2. These GTC govern the mutual rights and obligations between the Seller and any natural person concluding a purchase contract as a consumer (hereinafter "Buyer") via the online store located at www.vacice.com.

  3. The provisions of the GTC are an integral part of the purchase contract.

  4. These GTC and the purchase contract are concluded in the English language.

 

II. Product Information and Pricing

 

  1. Information about goods and prices is listed in the online store catalog. Prices are final and include VAT.

  2. Price Transparency: Whenever a price reduction (sale/discount) is announced, the Seller displays the lowest price at which the product was sold during the 30-day period prior to the reduction, in accordance with EU consumer protection laws.

  3. Shipping costs are calculated in the order form before the final confirmation of the order.

 

III. Order and Conclusion of the Purchase Contract

 

  1. The Buyer places an order via a customer account or as a guest. By clicking the "Order with obligation to pay" button, the Buyer submits a proposal to conclude a purchase contract.

  2. Upon receiving the order, the Seller sends an automatic email acknowledging receipt of the order into the system. This email is for technical confirmation purposes only and does not constitute a binding acceptance of the purchase contract.

  3. The purchase contract is concluded only at the moment of explicit confirmation of the order by the Seller, which is understood as an email confirming the shipment of the goods (shipping confirmation).

  4. The Seller reserves the right not to confirm an order (not to conclude the contract) in cases of obvious pricing errors, stock unavailability, or if the Buyer has a record of repeated failure to collect/accept previous shipments in the Seller's system.

 

IV. Customer Account

 

  1. Based on registration, the Buyer can access their account. The Buyer is obliged to provide correct data and protect their access password.

 

V. Payment Terms and Delivery

 

  1. The price of the goods and shipping costs can be paid via: bank transfer, online card payment (GoPay), or deferred payment (e.g., Klarna/Ahoj), depending on the country of delivery.

  2. In the case of non-cash payment, the price is due within 5 days of placing the order.

  3. The Seller delivers the goods to the address specified by the Buyer or to a designated pick-up point. The Buyer acquires ownership of the goods upon full payment of the purchase price and physical receipt of the goods.

 

VI. Right of Withdrawal (Returns)

 

  1. The consumer has the right to withdraw from the contract without giving a reason within 14 days of receiving the goods.

  2. Goods must be returned unused, unwashed, undamaged, and with original tags attached.

  3. The Buyer bears all costs associated with returning the goods to the Seller.

  4. Processing of Returns and Refunds: The Seller will process the returned goods and refund all received payments (including the cost of the least expensive standard delivery offered) no later than 14 days from the date the returned goods are physically delivered back to the Seller's address.

  5. The Seller is not obliged to issue a refund until the goods are delivered or until the Buyer provides proof of shipment.

 

VII. Liability for Defects (Warranty Claims)

 

  1. The Seller is liable for defects existing at the time of delivery that manifest within 24 months.

  2. The Buyer has the right to choose between repair or replacement of the defective item.

  3. The Buyer is entitled to a reasonable price reduction or withdrawal from the contract (full refund) if the Seller fails to remedy the defect, the defect reappears, or the defect is of a serious nature.

  4. The Seller will resolve the warranty claim within 30 days. In the case of a justified claim, the Seller covers the shipping costs.

 

VIII. Communication

 

  1. The parties may deliver all written correspondence to each other via electronic mail (email).

 

IX. Dispute Resolution

 

  1. Consumers have the right to seek a remedy from the Seller. If the Seller declines or fails to respond within 30 days, the Buyer may submit a proposal for alternative dispute resolution (ADR) or use the EU Online Dispute Resolution platform at: http://ec.europa.eu/consumers/odr.

 

X. Final Provisions

 

  1. All agreements are governed by the laws of the Slovak Republic. This does not affect consumer rights resulting from mandatory laws in the Buyer's country of residence.
